Can't get outside theme to be used as default

When trying to use unexploded Wars for portlets and themes I get errors and things do not render correctly
Example error (ERROR [ThemeLocalServiceImpl:707] Real path for XXXXXX is null and ERROR [ServletContextUtil:89] Real path for XXXXX is null)

The secondary issue is on hot deploy.. if the wars are exploded when a hot deploy happens it usually does not akknoledge the change i have to shut down the server and delete out the work folder for the portlet/theme and delete the folder under webapps and then restart the server and redeploy the war in question.

For this problem i have tested it with liferay 5.1.x, i can duplicate the problem also i have attached the war file that i use.
Here are the duplicate steps:
1.modify unpackwar property to false in server.xml whicn locate in CATALINA_HOME/conf folder.

2.copy the war that i attached to webapps folder.
