To reproduce:
1. Enable Staging
2. Create a Widget page
3. Add Web content display widget to the page
4. Config the widget -> Scope tab -> Create a new Page scope
5. Go to Control panel -> Content -> Select the page scope
6. Create a folder
7. Check available menuitems for the folder

Actual result:
Publish to Live menuitem is there. Getting "Error: Your request failed to complete." at clicking on it.

Expected:
No Publish to Live menuitem to be available.

Tested on master 1b9ae20 and on 7.1.x f179212
